1. Introduction
Welcome to The Winnipeg Actors Academy ("Academy," "we," "us," or "our"). These Terms and Conditions ("Terms"), along with our Cancellation and Refund Policy, govern your registration for and participation in any classes, workshops, or training programs ("Programs") offered by The Winnipeg Actors Academy through our website at www.thewinnipegactorsacademy.com or through any other registration method.
By registering for any Program, you ("Participant," "Student," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms and our Cancellation and Refund Policy. If you are registering on behalf of a minor, you represent that you are the parent or legal guardian and agree to these Terms on their behalf.

2. Definitions
For the purposes of this document:

  • "Program" refers to any acting class, workshop, course, intensive, or training session offered by The Winnipeg Actors Academy.

  • "Registration" refers to the process of enrolling in a Program and submitting payment.

  • "First Class" refers to the first scheduled session of the Program for which you have registered.

  • "Business Days" refers to Monday through Friday, excluding statutory holidays observed in Manitoba.

  • "Fees" refers to all tuition, registration fees, and any other charges associated with a Program.


3. Registration and Enrollment
3.1 Eligibility
Programs may have specific age requirements, prerequisites, or skill-level recommendations. It is your responsibility to ensure you meet any stated eligibility criteria before registering.
3.2 Registration Process
Registration is complete only upon:

  • Submission of a completed registration form with accurate personal information; and

  • Receipt of full payment of applicable Fees.

3.3 Confirmation
Upon successful registration, you will receive a confirmation email to the address provided. This confirmation serves as your receipt and proof of
enrollment.

3.4 Accuracy of Information
You agree to provide accurate, current, and complete information during registration. The Academy reserves the right to cancel any registration made with false or misleading information without refund.

4. Payment Terms
4.1 Payment Methods
We accept payment via credit card, debit card, and other payment methods as indicated at the time of registration.
4.2 Fees
All Fees are quoted in Canadian Dollars (CAD) and are due in full at the time of registration unless an alternative payment arrangement has been expressly agreed upon in writing.
4.3 Taxes
All applicable taxes (including GST/PST) are not included in the stated Fees unless otherwise indicated.
4.4 Failed Payments
In the event of a failed or declined payment, your registration will not be confirmed until successful payment is received. The Academy is not responsible for holding spots in Programs for incomplete registrations.

5. Cancellation and Refund Policy
We understand that circumstances may arise requiring you to cancel your registration. Please review our cancellation and refund terms carefully:
5.1 Cancellations Made More Than 48 Hours Before the First Class
If you cancel your registration more than forty-eight (48) hours before the scheduled start time of your First Class, you will receive a full refund (100%) of all Fees paid.
5.2 Cancellations Made 48 Hours or Less (But More Than 24 Hours) Before the First Class
If you cancel your registration forty-eight (48) hours or less, but more than twenty-four (24) hours, before the scheduled start time of your First Class, you will receive a fifty percent (50%) refund of all Fees paid.
5.3 Cancellations Made 24 Hours or Less Before the First Class
If you cancel your registration twenty-four (24) hours or less before the scheduled start time of your First Class, no refund will be issued. This includes failure to attend the First Class without prior notice ("no-shows").
5.4 Cancellations After the Program Has Commenced
Once a Program has commenced (i.e., after the First Class has taken place), no refunds will be issued for any reason, including but not limited to non-attendance, withdrawal, or dissatisfaction with the Program.
5.5 How to Request a Cancellation
All cancellation requests must be submitted in writing via email to the Academy at the contact information provided in Section 14 of these Terms. Cancellation requests are considered received at the time the email is sent, as determined by the timestamp on the email.
5.6 Processing of Refunds
Approved refunds will be processed within ten (10) to fifteen (15) Business Days from the date the cancellation request is approved. Refunds will be issued to the original method of payment.

6. Academy's Right to Cancel or Reschedule
6.1 Cancellation by the Academy
The Academy reserves the right to cancel any Program due to insufficient enrollment, instructor unavailability, or other unforeseen circumstances. In the event of cancellation by the Academy:

  • You will be notified as soon as reasonably possible via the contact information provided during registration.

  • You will receive a full refund (100%) of all Fees paid for the cancelled Program; or

  • At your election, you may transfer your registration to another available Program of equal or lesser value (with a refund of any difference in Fees).

6.2 Rescheduling by the Academy
The Academy reserves the right to reschedule classes or modify Program schedules due to unforeseen circumstances. We will make reasonable efforts to notify you of any schedule changes in advance. If a rescheduled time does not work for you and no suitable alternative is available, you may request a refund in accordance with Section 6.1.
6.3 Instructor Substitution
The Academy reserves the right to substitute instructors at any time without prior notice. Instructor substitution does not entitle Participants to a refund.

7. Transfers and Credits
7.1 Transfer to Another Program
Requests to transfer your registration to a different Program may be accommodated at the sole discretion of the Academy, subject to availability and provided the request is made more than forty-eight (48) hours before the First Class of the originally registered Program. Transfer requests made within 48 hours of the First Class will be treated as cancellations and subject to the refund terms outlined in Section 5.
7.2 Transfer to Another Person
Registration transfers to another individual may be permitted at the Academy's sole discretion, provided:

  • The request is made in writing at least 48 hours before the First Class;

  • The transferee meets any applicable eligibility requirements for the Program; and

  • The transferee agrees to these Terms.

7.3 Credits
At the Academy's sole discretion, credit toward future Programs may be offered in lieu of a refund. Program credits are non-transferable and must be used within twelve (12) months of issuance, after which they will expire.

8. Attendance and Participation
8.1 Attendance
Regular attendance is essential to your development as an actor and to the overall success of the ensemble learning environment. Missed classes will not be refunded, credited, or rescheduled.
8.2 Punctuality
Participants are expected to arrive on time for all sessions. Late arrivals may be asked to wait for an appropriate moment to join the class so as not to disrupt ongoing instruction.
8.3 Participation
Active participation is encouraged and expected. The Academy reserves the right to dismiss any Participant whose behavior disrupts the learning environment, without refund.

9. Code of Conduct
9.1 Professional Environment
The Winnipeg Actors Academy is committed to fostering a supportive, respectful, and professional community. All Participants are expected to:

  • Treat fellow students, instructors, and staff with respect and courtesy;

  • Refrain from harassment, discrimination, or bullying of any kind;

  • Maintain a positive, collaborative, and constructive attitude;

  • Follow all instructions provided by Academy staff and instructors; and

  • Respect Academy property and facilities.

9.2 Dismissal
The Academy reserves the right, at its sole discretion, to dismiss any Participant who violates this Code of Conduct or whose behavior is deemed detrimental to the Program or other Participants. Dismissed Participants will not be entitled to any refund.

10. Assumption of Risk and Liability Waiver
10.1 Assumption of Risk
Participation in acting classes and workshops may involve physical activity, including but not limited to movement exercises, stage combat, and improvisation. By registering for a Program, you acknowledge and voluntarily assume all risks associated with your participation.
10.2 Waiver and Release of Liability
To the fullest extent permitted by law, you agree to release, waive, discharge, and hold harmless The Winnipeg Actors Academy, its owners, officers, employees, instructors, agents, and representatives from any and all claims, liabilities, damages, costs, or expenses arising out of or related to your participation in any Program, except to the extent caused by gross negligence or willful misconduct of the Academy.
10.3 Personal Property
The Academy is not responsible for loss, theft, or damage to personal property brought to Academy premises.
10.4 Health and Medical Conditions
You are responsible for disclosing any health conditions, injuries, or limitations that may affect your ability to participate safely. If you have any concerns, please consult with a medical professional before participating.

11. Media Release and Consent
11.1 Photography and Recording
The Academy may photograph or record classes, workshops, performances, and other activities for promotional, educational, or archival purposes.
11.2 Consent
By registering for a Program, you grant The Winnipeg Actors Academy a non-exclusive, royalty-free, perpetual license to use your name, likeness, image, voice, and performance in photographs, videos, and other media for marketing, promotional, and educational purposes without additional compensation or prior approval.
11.3 Opt-Out
If you do not wish to be photographed or recorded, you must notify the Academy in writing prior to the start of the Program. We will make reasonable efforts to accommodate such requests, but cannot guarantee exclusion from all media.

12. Intellectual Property
12.1 Academy Materials
All curriculum, instructional materials, handouts, exercises, and other content provided by the Academy ("Academy Materials") are the intellectual property of The Winnipeg Actors Academy and are protected by copyright and other intellectual property laws.
12.2 Permitted Use
Academy Materials are provided for your personal, non-commercial use only. You may not reproduce, distribute, modify, publicly display, or create derivative works from Academy Materials without the prior written consent of the Academy.
12.3 Recording Prohibited
Unless expressly authorized in writing, Participants may not record (audio or video) any portion of a Program.

13. Privacy and Personal Information
13.1 Collection and Use
The Academy collects personal information (such as your name, email address, phone number, and payment information) for the purpose of processing registrations, communicating with you about Programs, and improving our services.
13.2 Protection
We are committed to protecting your personal information and will not sell, rent, or share it with third parties except as necessary to provide our services or as required by law.
13.3 Privacy Policy

15. Amendments
The Academy reserves the right to modify or update these Terms and our Cancellation and Refund Policy at any time. Any changes will be posted on our website with an updated "Last Updated" date. Your continued registration for or participation in Programs following the posting of changes constitutes your acceptance of such changes.

16. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such finding shall not affect the validity of the remaining provisions, which shall continue in full force and effect.

17. Entire Agreement
These Terms, together with any registration forms, waivers, or other documents referenced herein, constitute the entire agreement between you and The Winnipeg Actors Academy with respect to your registration for and participation in Programs and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.

18. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Province of Manitoba and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of the Province of Manitoba.

19. Acknowledgment and Acceptance
By completing your registration for any Program offered by The Winnipeg Actors Academy, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, including our Cancellation and Refund Policy.
